not necessarily.. if the prosecution can prove 1 of 2 things, you're going to jail. 1- premeditated. 2- you were in control of your mental faculties and knew what you were doing. Expect to do WAY more than 5 years..

or you can be some punk in philadelphia and end up doing more time for drugs than killing a 20 year old college student. some murderers get out in like 2 years, its a joke.

But ya, some of the laws need some revision even up here in canada when people get out of jail after 5 years for killing someone and a drug dealer gets 10 years for dealing? I don't know about these laws, but doesnt matter because I don't plan on selling drugs or killing someone anytime soon
Unlike some a$$hole here in az he almost got away with drowning his wife in the swiming pool by saying he slept-walk-killed wich sleep walking was a chronic problem for him if it wernt for the fact ath he knew about his wife cheating on him.
wynton - how can it be premeditated if you walk in and catch your spouse cheating on you? you didnt know it was going to happen. and it can be enough to send you into a fit of temporary insanity. so yes, my point is valid. in fact, i was recently locked up with a guy who caught that same charge, and is doing five years for it as we speak.
one time i was locked up with a dude who was in for life on charges of being criminally hot and unlawful possesion of a sexy body ... and that dude was me.
Premeditated in the sense that you know your spouse is cheating on you; the only thing you need to do is catch him/her in the act and...eliminate them.
